Acceptance of Terms

By accessing and using HomePacket, you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service. We reserve the right to modify these terms at any time, and your continued use of HomePacket following the posting of revised Terms means that you accept and agree to the changes.

Description of Service

HomePacket is a web-based home management platform that allows users to organize, track, and document their residential properties, appliances, systems, and maintenance history. The service is currently provided free of charge and includes features for creating account profiles, storing home information, and accessing an AI-powered assistant. In the future, HomePacket may offer premium paid features, including but not limited to the generation of professional home inspection and maintenance documentation in PDF format, which may be made available through a Stripe-based payment system.

Account Registration and Security

To use certain features of HomePacket, you must create an account and provide accurate, current, and complete information as requested during the registration process. You are responsible for maintaining the confidentiality of your account credentials and are responsible for all activity that occurs under your account. You agree to notify HomePacket immediately of any unauthorized use of your account or any other breach of security. HomePacket will not be liable for any loss or damage arising from your failure to protect your account information.

User Content and Data Ownership

Your data is yours. You retain full ownership of all content, data, documents, files, and information you create, upload, or store in HomePacket, including home details, appliance records, maintenance logs, notes, and any user-uploaded files. HomePacket will never sell, rent, or share your data with advertisers or data brokers. By uploading or storing content in HomePacket, you grant HomePacket a non-exclusive, worldwide, royalty-free license to access, use, display, and process your data solely for the purpose of providing the Service to you. This license exists only to operate HomePacket on your behalf — not to monetize your information.

You may delete your data or your entire account at any time. When you delete something, we delete it — we don't keep hidden copies for our own use.

You represent and warrant that you own or have the necessary rights to all content you upload, and that your content does not infringe upon any third-party intellectual property or privacy rights. You are solely responsible for your content, and HomePacket is not responsible for any content you upload or store in your account.

AI Features Disclaimer

HomePacket includes an AI-powered assistant that provides informational responses and recommendations based on the data you provide. This AI is powered by Claude, an artificial intelligence developed by Anthropic. The information provided by the AI assistant is for informational purposes only and should not be treated as professional advice.

The AI assistant is not a substitute for, and does not provide, professional home inspection, home repair, real estate, legal, financial, or construction advice. HomePacket does not employ or represent licensed professionals in these fields. Before making any significant decisions regarding your home, including repairs, renovations, purchases, or maintenance, you should consult with appropriately qualified professionals such as licensed home inspectors, contractors, real estate agents, or other specialists. The AI may make mistakes or provide inaccurate information, and HomePacket is not responsible for any decisions or actions you take based on AI-generated responses.

Acceptable Use

You agree not to use HomePacket for any unlawful purpose or in violation of any applicable laws or regulations. You further agree not to engage in any conduct that restricts or inhibits anyone's use or enjoyment of HomePacket, or which, as determined by HomePacket, may harm HomePacket or users of HomePacket, or expose them to liability.

Specifically, you agree not to engage in any of the following prohibited behaviors: attempting to reverse engineer, decompile, disassemble, or otherwise discover the underlying source code, structure, or trade secrets of HomePacket; scraping, crawling, or automatically collecting data from HomePacket; uploading malware, viruses, or other harmful code; attempting to gain unauthorized access to HomePacket or its systems; harassing, threatening, or defaming other users; uploading content that infringes on intellectual property rights; or circumventing security measures or authentication protocols.

Paid Services and Billing

HomePacket is currently offered free of charge. In the future, we may introduce premium paid features, including professional home documentation services, which will be processed through Stripe or other third-party payment processors. If you purchase a paid service, you agree to pay the stated price plus any applicable taxes. Payment terms, billing cycles, and cancellation policies for paid services will be clearly disclosed at the time of purchase.

Intellectual Property

HomePacket, including but not limited to the HomePacket name, logo, branding, design, user interface, layout, functionality, code, software, and all content and materials available on or through the Service (excluding user-uploaded content), are the exclusive property of HomePacket or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use HomePacket for your personal use only. This license does not grant you the right to reproduce, distribute, modify, create derivative works, display, perform, or otherwise use any portion of HomePacket without our prior written consent.

Disclaimer of Warranties

HomePacket is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. HomePacket disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. HomePacket does not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your specific requirements or expectations.

HomePacket does not guarantee the accuracy, completeness, timeliness, or reliability of any information, including AI-generated responses, home data, or user-submitted content. We are not responsible for any errors, omissions, or inaccuracies in the Service or for any loss or damage resulting from your reliance on the Service or its content.

Limitation of Liability

To the fullest extent permitted by law, HomePacket and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of business opportunity, or other intangible losses, even if HomePacket has been advised of the possibility of such damages.

In no event shall HomePacket's total liability to you for all claims arising out of or relating to these Terms or your use of HomePacket exceed the amount you have paid to HomePacket in the past twelve months, or if you have not paid anything, one hundred dollars ($100). Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless HomePacket and its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of HomePacket, your violation of these Terms, your violation of any applicable law or regulation, or your infringement of any third-party rights. This obligation applies regardless of whether the claim is based on contract, tort, strict liability, or any other legal theory.

Termination

HomePacket may terminate or suspend your account and access to the Service at any time, for any reason or no reason, with or without notice. Reasons for termination may include, but are not limited to, your violation of these Terms, your violation of applicable law, or HomePacket's decision to discontinue the Service or your account.

Upon termination, your right to use the Service immediately ceases. HomePacket will not be liable for any loss or damage resulting from termination of your account. Data retention and deletion policies for terminated accounts will be determined in accordance with HomePacket's Privacy Policy.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of or related to these Terms or your use of HomePacket shall be brought exclusively in the state or federal courts located in California.

Changes to Terms

HomePacket reserves the right to modify these Terms of Service at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page or by sending you an email notification. Your continued use of HomePacket following the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the revised Terms, you should stop using HomePacket.
